Although I'd sworn off posting to the existing discussion threads concerning exactly what powers the Administration has in the current not-quite-declared war situation, SixDifferentWays posted a new comment that posed just such questions. Even that would not be sufficient to draw a comment from mt, but seeing that Dodd of Ipse Dixit posted the quote from Senator Biden's press conferance that he claims settles the matter, I had to respond. I'm happy to report that my comments there were better received (thanks, Anna and Scott!).
I also located a copy of the 1942 Ex Patre Quirin ruling that apparently is being used to justify certain detentions. Upon reading it, I'm even more convinced that it fails to justify the powers to detain American citizens indefinitely without trial that the Administration claims. Former Presidential counsel John Dean sees the potential for the rise of a "Constitutional dictatorship."
In further updates, some of my responses seem to have disappeared from these two threads at Alley Writer. Hmmm...I'll see if I still have copies somewhere.
